Hei, my ex gf refuses to return the significant amount of money that she borrowed/took from me under false pretenses. In one year relationship, she made me to believe that she must payoff the loan to loan sharks otherwise her and her family will be in danger. Then, she told me her father got injured and they urgently needed money for the treatment. After she got all the money from me, she immediately ended relationship with me. Then, I found out the money that supposedly for her debt and her father's treatment was actually used for herself and her wedding (she got married to her so-called ex behind my back). Is her action considered as a fraud? How can I get my money back?

Yes, based on Finnish laws, your ex-girlfriend's actions may be considered fraud (petos) if she obtained the money from you under false pretenses. Fraud is defined under Finnish Criminal Code (39/1889) Chapter 36, Section 1, where it states that a person who deceives someone into a financial loss by providing false information or withholding critical facts can be held liable for fraud. Since she allegedly lied about needing money to pay off dangerous debts and her father’s treatment, and then used the funds for other personal expenses, this could constitute fraudulent misrepresentation if she knowingly misled you to obtain financial gain. You should file a report with the Finnish police, as they have the authority to investigate cases of fraud. Provide as much evidence as possible, such as messages, bank transfers, and any communications where she mentioned the loan purpose. This will help establish a pattern of deceit and give authorities a basis for pursuing a case. Alongside criminal proceedings, you may consider filing a civil claim for debt recovery. This would involve bringing a lawsuit against her in civil court to recover the amount owed. If you can show that the money was obtained under false pretenses, the court may rule in your favor and order her to repay the amount. If she is convicted of fraud, this can support your civil case and make it easier to enforce repayment. The court may issue an enforceable judgment, allowing you to seek assistance from enforcement authorities (ulosotto) for repayment if she fails to comply. Due to the complexity of proving intent in fraud cases and the substantial amount involved, consulting a lawyer experienced in Finnish fraud and debt recovery law may improve your chances of success.
